Austin Long Term Disability Appeals Lawyer

Helping Individuals in Austin who have been Denied Long Term Disability Benefits File an Appeal in their Case

It is not uncommon for insurance companies to deny applications for long term disability benefits. Fortunately, you may be able to appeal a benefits denial in an attempt to receive these benefits. This is because appeals at each level are decided by different individuals and claim units, and a different evaluator might reach a different decision on a particular appeal. If your application for long term disability benefits has been denied, you might have options available to you.

Carefully Examining a Denial Letter

Prior to filing an administrative appeal, it is important that you carefully read and understand your denial letter. In denying your application for long-term disability benefits, the insurance company is required to lay out all of the reasons for denying your claim. If you decide to appeal the claim denial, you can then make sure that you address all of the concerns which the insurance company raised in its denial letter. For example, if the insurance company denied your benefits claim because it did not contain ample documentation, then you should make sure that you include all pertinent medical documentation, including imaging studies, to support your appeal.

Complying with the Appeal Time Requirements

Some long-term disability claims are denied simply because the applicant did not comply with all of the necessary time requirements. This is an easy fix, and you must ensure that your appeal documentation is submitted in a timely manner. Although an insurer is required by law to provide you with a minimum of 60 days with which to file appeal documentation, many insurance policies give appellants more than 60 days to file their documentation. An Austin long-term disability appeals lawyer can help you with assembling all of the appeals documentation in a timely manner.
