If you have made a claim that arises out of an ERISA policy, there are numerous steps that you need to take quickly. You may have an opportunity to appeal an ERISA denial with your insurance company, and if that does not work, you may be eligible to appeal your case in the federal court system, during which a federal judge will make the decision.

When you are dealing with an ERISA denial, it is extremely helpful to have an experienced attorney on your side who can assist you throughout the process and make sure that you understand all of your legal rights. The knowledgeable Austin ERISA denied claims lawyers at the Law Offices of J. Price McNamara can assist you with appealing a claim denial. Types of Benefits Available under an ERISA Plan

Many people receive various types of insurance coverage through their employers. In many cases, these insurance plans fall within the Employee Retirement Income Security Act of 1974 – the ERISA statute. Employer-sponsored insurance plans that fall within the ambit of the ERISA statute include long-term disability insurance plans, accidental death plans, life insurance plans, and health insurance plans, to name a few.

When a certain event occurs, you or your plan beneficiary may be eligible to make a claim against the plan for coverage. Insurance companies, however, often find a reason to limit coverage – or even deny the claim outright. When you think about it, though, this makes sense, since first and foremost, insurance companies are in the business of making money. They do not earn money by paying out insurance claims.

Appealing an ERISA Benefits Denial

If you are denied coverage or benefits under an ERISA plan, there are several legal steps that you may be able to take. First, the insurance company must allow you at least one opportunity to appeal a claim denial. This is called an administrative appeal since it is handled by the insurance company in-house. During the administrative appeals process, you will have an opportunity to supplement the record with additional documentation.

After you have exhausted each step in the administrative appeals process, if you still do not have benefits, you may be able to appeal your case to federal court. The first step in the federal appeals process is to file suit against your insurance company. During a hearing, a federal judge – as opposed to a jury – will decide your case and make a determination about your entitlement to benefits.

Our number-one goal is getting you and your family back to financial security as soon as possible.
