Denial of Benefits

As stated previously, insurance companies have a strong incentive to deny benefits under an employer-sponsored ERISA plan. In the event the insurance company denies your claim for benefits under a plan, there are certain legal steps that you need to take. Those steps include the following:

  • Read the denial letter carefully — Whenever an insurance company decides to deny your claim for benefits, it is required to send you a denial letter stating why. The letter will also set forth the steps that you need to follow in order to file an appeal of your claim denial. For example, you may have to attach additional documentation in support of your claim, as part of the administrative appeal. You should make sure that you follow everything stated in the letter, in order to maximize your chances of success on appeal.
  • File an administrative appeal — Filing an administrative appeal is typically the first step in the appeals process for a denied ERISA insurance claim. During this stage of the game, you have the opportunity to supplement the administrative record with additional documentation. If the case ultimately goes to federal court, you will no longer have an opportunity to supplement the record at that time. Therefore, it is essential that you obtain all relevant documentation and submit it to your insurance company as part of the administrative appeal.
  • Appeal the ERISA insurance claim to federal court — If you have exhausted all of the administrative appeal remedies offered by your insurance company, and you still have not received the benefits that you need, you may have the opportunity to appeal your case to federal court. In the federal court system, a judge will make a determination about whether or not you are entitled to benefits under your employer-sponsored ERISA plan. The judge will make this decision after reviewing the administrative record and considering all of the facts and circumstances.
