Austin Bad Faith Claims Attorney

Assisting Individuals in Austin with Resolving a Bad Faith Insurance Claim

Insurance companies owe their insureds several legal duties. Arguably, one of the most important of these duties is the duty of good faith and fair dealing when it comes to investigating and resolving a pending insurance claim. This duty of good faith is present in the insurance contract which an insured signs off on.

Despite this covenant of good faith and fair dealing, however, insurance companies sometimes do not live up to their end of the bargain, and they act in bad faith. Remember that insurance companies are most interested in making a profit. They do not make a profit when they are constantly paying out insurance claims. Consequently, insurance adjusters will do everything they can to limit the insurance company’s exposure under an insurance contract.

If you have filed a claim with an insurance company which you believe the insurance company denied in bad faith, an experienced Austin bad faith claims lawyer may be able to assist you. Attorney J. Price McNamara of the Law Offices of J. Price McNamara can investigate the circumstances of the denial and determine your appeal options. Please contact us online today to discuss all of your legal options.

What Does it Mean for the Insurance Company to Act in Good Faith?

An insurance company is required to act in good faith during all of its dealings with you. Acting in good faith means that the insurance company evaluates your claim in an honest, fair, and impartial manner. Moreover, the insurance company must make a good faith effort to settle claims which have been filed against an individual who is covered under a policy, if the claim can be settled within the policy limits of insurance coverage.

How Insurance Companies may Act in Bad Faith

There are several ways in which insurance companies may act in bad faith. In one instance, the insurance company may deny a particular claim that falls squarely within the insurance policy’s coverage limits — and without stating a good reason for the denial.

Moreover, the insurance company may act in bad faith by dragging its feet too long when investigating a claim, or by failing to make a reasonable settlement offer on the claim. Finally, an insurance adjuster could intentionally misrepresent the coverage terms of an insurance policy.

Our number-one goal is getting you and your family back to financial security as soon as possible.
