Long Term Disability / Life /

Helping Individuals in Arlington Pursue Benefits for Long-Term Disability Insurance Benefits

Many workers receive long-term disability benefits through their employers. When employers sponsor a long-term disability plan, it is usually covered under a federal statute called ERISA – or the Employee Retirement Income Security Act of 1974. Although this statute was initially put in place to ensure that employees receive the benefits that they deserve, that goal sometimes backfires, and employees end up shortchanged. In fact, insurance companies have no incentive to pay out benefits, as that is money lost.

If you have been denied long-term disability benefits, it is important that you have experienced legal counsel representing you in your case. The Arlington long-term disability insurance lawyers at the Law Offices of J. Price McNamara are ready to help you pursue the long-term disability benefits you deserve. Please contact us online today for more information and to schedule a free case evaluation and legal consultation.

Eligibility for Long-Term Disability Benefits

In order for you to be eligible for long-term disability benefits, there are certain requirements that you must satisfy. First, you must be suffering from a long-term illness or injury. Secondly, that injury or illness must prevent you from working in any capacity.

In order to prove that you are eligible for these long-term benefits, a doctor must be able to state in writing that your injury or illness wholly prevents you from working in any capacity.

Our number-one goal is getting you and your family back to financial security as soon as possible.

What to do when a Long-Term Disability Benefits Claim is Denied

Even when an individual seemingly meets the requirements for obtaining long-term disability benefits, the insurance company may still come up with a reason to deny your benefits claim. The insurance company, for example, may contend that you did not file your claim within the proper time period, that you did not follow all of the administrative protocols, or that your application lacked the necessary medical documentation.

If the insurance company administratively denies your application for long-term disability benefits, it must include a letter that specifically states the reason or reasons why your claim is being denied. An experienced attorney can assist you with filing an administrative appeal and addressing the matters which the insurance company raises in its letter, increasing your chances of recovering benefits the second time around. If the insurance company denies your administrative appeal, a lawyer may be able to help you appeal your case to the federal court system.
