Long Term Disability / Life /
Accidental Death / ERISA

Our past years of representing insurance companies taught us a thing or two about how they work behind the scenes. Let our experience work for you.

Arlington Long Term Disability Attorney

Helping Those in Arlington File or Appeal a Claim for Long Term Disability Benefits

Short and long-term disability benefits may be available through your employer, or you might have purchased a policy of insurance on your own. However, if you applied for these disability benefits, you should act as quickly as possible. In many instances, insurance companies do not hesitate to deny you the benefits to which you are entitled. Benefits might even be denied for failing to satisfy certain deadlines or follow certain rules.

Attorney J. Price McNamara of the Law Offices of J. Price McNamara could help you with filing your claim for long-term disability benefits and could assist you with appealing a disability denial if the insurance company denies the pending disability claim in your case. Hurdles That You Must Clear

In order for you to obtain long-term disability benefits, there are certain hurdles which you must first clear. Most importantly, you must be able to demonstrate that you are disabled within the definition of your insurance company’s policy. In addition, you must prove the extent of your long term disability by using medical evidence.

Under most insurance policies, total disability means that you are not able to work due to the injury or illness from which you suffer – and that you are not able to substantially perform your job duties. In addition to demonstrating that you are medically disabled, you must ordinarily satisfy other requirements to obtain long term disability benefits. Those requirements include the following:

  • Under an employer-sponsored plan, you must be a full-time employee when you first become disabled
  • You must go through a waiting period which typically lasts for three to six months before you are eligible to collect any long term disability benefits
  • If a preexisting medical condition or illness is present, you generally cannot receive long term disability benefits arising from the preexisting condition during the initial 12-month period that you are covered for LTD benefits
  • You must ensure that your particular injury or medical condition is covered by your policy of insurance. Some long term disability insurance policies specifically exclude certain types of workplace accidents or illnesses.

A knowledgeable Arlington long term disability attorney can review your circumstances and determine your eligibility for various benefits.

Our number-one goal is getting you and your family back to financial security as soon as possible.
