Who Can File a Life Insurance Benefits Claim?

There are several important parties to a life insurance policy. The insured is the individual who takes out a life insurance policy, in many cases, through his or her employer. In the event that an employer sponsors a life insurance policy, the Employee Retirement Income Security Act of 1974, also known as ERISA, likely controls the policy.

When the insured takes out his or her policy of life insurance, the insured will designate a beneficiary. The beneficiary is the individual who is entitled to a payout once the insured passes away. Depending upon the insurance company, the insured may be able to designate one beneficiary or more than one beneficiary under the policy.

When the time comes that the insured passes away, the beneficiary asserts his or her rights to benefits by making a claim under the life insurance policy.

Why Was My Claim for Life Insurance Benefits Denied?

Life insurance companies deny claims for benefits under many different circumstances. In some instances, there may be some kind of dispute over the identity of a particular beneficiary under the policy. When an insured dies within two years of taking out a life insurance policy, it is very likely that the insurance company will investigate the claim, prior to making a decision.

At other times, the insurance company might conclude that the insured‘s death falls without a policy exclusion. For example, if the insured contributed to his or her death, those circumstances may be excluded under the policy, and the beneficiary may not be entitled to a payout. Finally, the insurance company may allege that the beneficiary did not follow the proper procedures to make a claim under the policy, or that he or she did not make a claim in a timely manner.

If your life insurance claim for benefits has been denied, you may have several options under the law. First, you may be able to file an administrative appeal of the denial decision with your insurance company. During this time, you will have an opportunity to produce additional documentation that supports your right to benefits. 

After you have exhausted the administrative appeals process, and if the insurance policy falls within ERISA, you may have the option of appealing the denial to federal court. When you appeal a benefits denial to federal court, a judge ultimately decides whether or not you are entitled to benefits.
