Fiduciary Duties of an Insurance Company

When you have a policy of insurance in place with an insurance company, the insurance company has several different duties. One of the duties which an insurance company owes to its insureds is the fiduciary duty to pay all valid claims in both a prompt and efficient manner. Moreover, the insurance company is required to act in good faith when it comes to processing and settling your insurance claim. In cases where insurance companies fail to follow through on their duty of good faith, they are arguably in breach of the insurance contract. In those instances, the insured might be entitled to recover monetary compensation under a breach of contract theory of recovery.

Once an insurance company receives a claim, they are required to begin investigating the claim promptly, and they must notify the claimant as to whether or not they are accepting or denying the claim. They must also pay a claim which they have accepted, generally within 60 days of receiving the necessary documentation. 

In some cases, however, the insurance company acts in bad faith and wrongfully denies a claim. Acting in bad faith could include failing to investigate a claim thoroughly, failing to acknowledge a claim that was timely submitted, failing to provide an explanation for delaying, denying, or underpaying a claim – or even attempting to settle a valid claim for an unreasonable amount. An insurance company may also act in bad faith by requesting that the insured submit necessary or irrelevant documentation as proof of a claim.
