Arlington Accidental Death Insurance Claims Lawyer

Assisting Individuals in Arlington with an Accidental Death Insurance Claim or Appeal

Accidental death benefits may be available to individuals under an employer-sponsored ERISA plan. Under one of these plans, an insured can designate a beneficiary who is entitled to a monetary payout, in the event the insured individual passes away in a fatal accident.

Surprisingly, however, insurance companies routinely deny insurance claims under accidental death policies. In fact, many insurance companies will do anything that they possibly can to avoid paying out a claim and retaining the money for as long as they can.

If this happens to you, and you are the designated beneficiary under a plan of insurance, you may be able to take legal action against the insurance company. At the Law Offices of J. Price McNamara, our legal team is ready and willing to help you pursue all of the accidental death benefits to which you are entitled. Please contact us today for more information and to schedule a free case evaluation and legal consultation.

What Qualifies as an Accident under an Insurance Policy?

When it comes to determining what types of events constitute accidents under a particular insurance policy, it depends largely upon the insurance company and the insurance policy at issue. In most cases, accidental circumstances are circumstances which occur totally by surprise, and which the insured does not cause or contribute to. Some common examples of deaths resulting from accidental circumstances include fatal motor vehicle crashes, boating accidents, drowning accidents, and slip and fall accidents.

Why did an Insurance Company Deny the Claim?

If you are the named beneficiary under an accidental death policy of insurance, you may be able to file a claim for insurance benefits once the insured passes away in an accident. However, the insurance company may deny your claim for a variety of different reasons. First of all, the insurance company may claim that the insured did not keep up with his or her premium payments during the lifetime of the policy, and that consequently, the policy was not in effect at the time of the insured’s death.

In other instances, the insurance company may claim that the insured did not truly pass away in an accident. For example, the insurance company may claim that based upon their internal investigation, the insured actually contributed to his or her death, such as by committing suicide.

Finally, the insurance company may allege that the insured passed away as a result of a pre-existing medical condition or illness that led to his or her untimely death. In these circumstances, you may be eligible to file an appeal of a benefits claim denial.

Our number-one goal is getting you and your family back to financial security as soon as possible.
