Accidental Death Insurance Claims Lawyer in Fort Worth

Assisting Citizens of Fort Worth, Texas with Pursuing and Recovering Accidental Death Benefits

Individuals apply for accidental death insurance benefits in hopes that their loved ones will be protected in the event they pass away unexpectedly in an accident. Surprisingly, however, many insurance companies will try and limit the insurance benefits paid to a beneficiary – sometimes even going so far as to deny a claim for benefits altogether.

Insurance companies actually have a very strong incentive to deny accidental death beneficiaries the benefits to which they are entitled. Insurance companies become wealthy entities by collecting – and keeping – the premiums that are paid by their insureds. Insurance companies do not make money by paying out claims for accidental death benefits and other types of benefits.

If you are in the process of making a claim for accidental death benefits under an insurance policy, or if you want to learn more about how to internally appeal a denial of benefits, the accidental death insurance claims lawyers at the Law Offices of J. Price McNamara may be able to help. Please contact us today for more information and to schedule a free case evaluation and legal consultation.

Determining Whether a Loved One’s Death was Accidental

The types of deaths that constitute an ‘accidental’ death will be defined in the insurance policy. Moreover, the policy will likely layout circumstances that are excluded from coverage under the accidental death policy. Accidental deaths are typically deaths which occur in the context of one of the following circumstances:

  • Slip and fall accidents
  • Accidents that occur on a boat or other watercraft
  • Drowning accidents
  • Motor vehicle accidents

When a beneficiary goes to make a claim under an accidental death insurance policy – especially if the death occurs soon after the policy is taken out – the insurance company will complete a thorough investigation into the circumstances leading up to the insured’s death.

Our number-one goal is getting you and your family back to financial security as soon as possible.

Claim Denials following an Internal Investigation

Once the insurance company completes its internal investigation, it must make a decision about whether to accept the claim and pay the beneficiary the funds to which he or she is entitled, or to deny the claim. There are several reasons why an insurance company may choose to deny a claim for accidental death benefits.

First, the insurance company might argue that some preexisting condition, rather than an accident, actually caused the insured’s death. In the alternative, the insurance company may conclude that the insured’s death was the result of some action or inaction on the insured’s part. In those instances, the insurance company may conclude that the insured’s death was not an accident at all, such as in the case of a death resulting from a suicide or self-inflicted injury.

When an insurance company investigates the claim and determines that there is no basis for coverage, you may be eligible to internally appeal that denial by producing documentary evidence to challenge the denial. An experienced Austin accidental death claims lawyer can help you throughout that process and pursue the benefits you need.
