Helping Austin Residents Pursue a Claim for Accidental Death Insurance and/or Appeal a Benefits Denial

Accidental death policies are in place as a safety measure to protect accident victims’ family members in the event of an unexpected, accidental death. However, when surviving family members go to make a claim, they are often surprised to learn that the insurance company is deciding not to honor the policy and deny the claim. When this happens, many questions often arise, and insurance policy beneficiaries are unsure of where to turn next.

The experienced accidental death insurance claims attorneys in Austin at the Law Offices of J. Price McNamara can answer all of your questions, explain your legal rights, and help you pursue a claim for accidental death benefits – or appeal an insurance company’s claim denial. Please contact us online today for more information and to schedule a free case evaluation and legal consultation.

How Accidental Death Insurance Policies Work

Many workers have the opportunity to take out an accidental death insurance policy through their employers. In those cases, the policy is often covered under the Employee Retirement Income Security Act of 1974 – a federal statute passed by Congress that is commonly known as ERISA.

When an individual decides to take out an accidental death insurance policy, he or she will usually pay monthly premiums in order for the policy to remain active. If the insured stops paying these premiums and the grace period lapses, then the policy can be terminated.

Moreover, when the insured first takes out the accidental death policy, the insured will designate one or more beneficiaries. In the event the insured passes away unexpectedly in an accident, the beneficiary or beneficiaries can then make a claim under the policy and may be entitled to a monetary payout. This payout can then be used to help offset certain costs for the insured, including funeral and burial expenses.

When Insurance Companies Deny Accidental Death Claims

Insurance companies can deny accidental death benefits under a variety of different circumstances. One common reason for denying an accidental death claim is in cases where the insured’s policy has lapsed due to non-payment of premiums. At other times, the insurance company may allege that the insured, in fact, did not pass away under accidental circumstances. For example, the insurance company might contend that the insured committed suicide or injured himself or herself in a way that led to an untimely death.

If the insurance company denies your claim for accidental death benefits, then you may be able to file an administrative appeal with the insurance company or with the court, depending upon the circumstances.

Our number-one goal is getting you and your family back to financial security as soon as possible.
