Who can File a Wrongful Death Claim?

Many states allow for the surviving relatives of a loved one who has died a wrongful death to file a claim up to two years after their loved one died. Such claims may be brought by the surviving spouse, child, or parents of the deceased either as individuals or as a group choosing to file the claim together.

Adult children may file a wrongful death claim on behalf of their parents, however, brothers and sisters may not be allowed to file a claim for wrongful death for their sibling under state statutes.

Compensation for Wrongful Death

The most common types of damages that a beneficiary seeks after the wrongful death of a loved one is compensatory damages, however, there are other types of damages they may be entitled to claim. These include, but may not be limited to, the following:

  • Pain and suffering
  • Burial costs
  • Medical expenses
  • Loss of future earnings
  • Loss of consortium

To determine some of these damages, such as the loss of future earnings, an expert may be required to help determine the amount the individual may have earned over his or her lifetime. An experienced accidental death attorney can help find the experts necessary to prove your case.

Obtain Legal Assistance to Prove a Wrongful Death Claim

The most important part of proving a wrongful death claim is proving that the other party acted in a negligent manner and their negligence resulted in the loss of your loved one. You may also need to prove how much income would be lost as well as pain and suffering damages. Wrongful death claims may also result in the claim needing to be filed against multiple parties. An experienced wrongful death attorney can help you determine what parties should be included in your claim.
